Privacy policy – personal data processing notice

Your privacy and the security of your data are important to us, therefore, the company BELGRADE ARBOR DOO BELGRADE – NEW BELGRADE (hereinafter: Company) as a data controller towards you, as a person from whom data relating to you is collected, provides you with the information listed below at the time of collecting such data, in accordance with the Law on Personal Data Protection (“Official Gazette of RS”, No. 87/2018, hereinafter: the Law).

These Privacy Policy (hereinafter: Policy) apply to natural persons, and personal data refers to all data through which we can directly or indirectly identify you. All of your personal information is treated as strictly confidential, and the Company and/or our trusted partners keep them in an adequate manner. Please carefully read these privacy policy. If you do not agree with our actions, please do not provide us with your personal data.

Subject of privacy policy

These Rules encompass the ways in which your personal data is processed when you interact with the Company, i.e. when you express interest in purchasing real estate or contact us regarding the conclusion of a contract for the sale of real estate within a residential and commercial complex, or when you:

– visit our website or pages that serve to advertise the Company’s projects;

– visit our profiles on social media pages;

– communicate with us by phone or through the contact form on the website or via email or in any other way;

– use our systems and applications;

– visit our sales outlets;

– attend our presentations or business events;

– participate in our promotional or marketing activities (e.g. newsletter sign-up), surveys, and similar activities;

– conclude a contract with us regarding the sale of real estate or another contract.

It is mandatory to provide only those personal data that we collect to fulfill certain legal obligations. Providing personal data for all other legal grounds is voluntary, but we note that if you deny us certain data, we may not be able to provide you with certain services in certain situations.

Personal data we collect

  1. Personal data of visitors to our website

    When you visit our website, or websites that advertise the Company’s projects, your browser will automatically send to our website server (without your action) the following information: IP address, date and time of access, name and URL of downloaded file, referrer URL, browser type, operating system (if necessary), and provider’s name. This data is stored temporarily in a log file for:

    – ensuring uninterrupted connection;

    – providing comfortable use of our website/application;

    – assessing security and stability of the system.Data is stored only during the visit and then deleted. The legal basis for processing IP address is Article 12, paragraph 1, point 6) of the Law on Personal Data Protection (legitimate interest).

  2. Marketing and other activities

    Personal data is collected based on your consent (e.g., for newsletter signup, direct marketing), to send commercial messages and marketing materials. Data submitted via contact forms, calls, or emails is used accordingly. If you’ve consented to receive newsletters via e-mail, SMS, Viber, or other, we use your email, phone number, name and surname for promotions, offers, news, and real estate-related communications. The legal basis is Article 12, paragraph 1, item 1) of the Law. You can withdraw consent anytime—revocation does not affect processing done before it. Unsubscribe through our site, newsletter link, Viber app, or SMS. Upon revocation, we delete your data. Third-party partners may be engaged to facilitate these services, so your email and phone number may be transferred to them.

  3. Personal data of real estate buyers

    We process necessary personal data for preparing, concluding, and executing sale contracts or pre-contracts (e.g., reservation, deposit agreements): name and surname, address, ID number, ID/passport number, copy of personal documents, phone, and email. The legal basis is Article 12, paragraph 1, points 2) and 3) considering contractual and legal obligations.

  4. Other personal data you provide

    Data voluntarily provided during contact, communication (calls, emails, forms), site visits, social media interaction, surveys, etc. – including identification and communication data – is processed to respond to inquiries, present offers, and ensure client satisfaction. Legal basis: Article 12, paragraph 1, item 6) – legitimate interest. Surveys are anonymous unless consent is given; then legal basis is consent (item 1). Revocation of consent doesn’t affect prior processing. You understand that absolute security cannot be guaranteed despite our best efforts.

  5. Personal data of social media users

    On our social media, we process data to inform about our complex, services, promotions, news—to interact and communicate with interested individuals. Legal basis: Article 12, paragraph 1, point 6) – legitimate interest. We cannot control platforms’ processing rules. For more info, see their data protection rules. User-generated content (comments, images, likes) is processed only as intended. We may delete inappropriate content and use it for communication purposes.

Access to your data

We consider your personal data a business secret and protect it accordingly, in compliance with applicable legal regulations and best practices. Within our company, access to the data you have provided is granted only to those organizational units or employees who need it to fulfill the purpose for which the personal data was collected. We will process your personal data ourselves, while third parties are allowed to access and process your personal data only in the situations described below:

– our trusted partners or legal entities with whom we cooperate in business and who assist us in regular operations. These may include entities that develop and maintain IT solutions and platforms, servers, as well as entities providing services on behalf of the Company, e.g., for marketing purposes. In such cases, these legal entities process your personal data exclusively for our needs. According to the contracts concluded, these service providers are obliged to use the data entrusted to them solely in accordance with our instructions and strictly for the purpose we have defined, with an obligation to adequately protect your data and keep it confidential;

– entities we cooperate with when we determine it is necessary to protect our specific and legitimate interests, such as tax advisors, accountants, insurance companies, lawyers, and other consultants. In such cases, these entities process your personal data exclusively for our needs;

– competent authorities during supervision of the legality of business operations and conduct, as well as other legal entities when required for the fulfillment of our legal obligations, such as auditors. In such cases, these legal entities process your personal data for the purpose assigned to them by law;

– other parties involved in business transactions, such as the sale of the company or part of it, reorganization, merger, joint venture, or any other type of disposition of our company or assets. Additionally, it may be necessary to forward part of your inquiries to contractual partners (e.g., suppliers, architects, or contractors) in cases related to specific products/materials, for the purpose of processing your inquiry. However, in such cases, the inquiry is first anonymized so that the third party cannot in any way link it to you. If, in an individual case, forwarding your personal data becomes necessary, we will inform you beforehand and request your consent. Third parties are limited in their ability to use your personal data for any purposes other than those stated and are required to protect and process your personal data in accordance with legal, regulatory, and contractual obligations. All legal entities we cooperate with are carefully selected, and when required by law, they are contractually bound to maintain the confidentiality of personal data, in accordance with Article 45 of the Law on Personal Data Protection.

Transfer of your personal data to other countries

In certain cases, we may share or transfer your personal data to other countries in accordance with the Law. When doing so, we transfer your data to servers located within the EU or to countries that provide an adequate level of protection in accordance with the legislation of the Republic of Serbia. Access will be granted only to a limited number of individuals, i.e., authorized persons, solely for the purpose of maintaining server functionality.

Way in which we protect your personal data

Some of the protection measures we implement include the following:

– applying modern methods of protection and access control to data sources containing personal information;

– restricting access to sensitive data, as well as limiting user accounts that may access certain data, by introducing a system of roles and authorizations to ensure that only specific employees who require access to perform their job duties can view and process the relevant data;

– continuous monitoring of all resources (physical premises where your data is stored) used for the processing of personal data.

The purpose of implementing these measures is to prevent the risk of destruction, loss, alteration, unauthorized disclosure, or access to your personal data. We also require third parties that have the right to access and process your personal data to apply appropriate protection measures. All personal data is stored on our server in the Republic of Serbia.

Please note that the above protection measures do not apply to information or data that you choose to share publicly through social networks or messaging applications.

Retention period of your personal data

Personal data is stored for as long as necessary to fulfill the purpose for which it was collected. If you have entered into a contract with us, we retain the data for the duration of the rights and obligations arising from that contract, and thereafter for as long as required by applicable regulations. We may also retain your personal data after the termination of the contractual relationship if it is necessary for the establishment, exercise, or defense of legal claims, or for compliance with relevant laws. To the extent possible, we will restrict the processing of your personal data to these limited purposes after the contractual relationship ends. Once the purpose has been fulfilled or the legally prescribed retention period has expired, the personal data will be permanently deleted.

Your rights

If you decide to exercise one or more of your rights listed below, we have the right to verify your identity for the purpose of protecting personal data. You can exercise your rights free of charge. However, if your request is clearly unfounded or excessive (for example, if you request personal data you already possess), particularly if such requests are made repeatedly, we reserve the right to charge the necessary administrative costs of processing your request or to refuse to act on it. Please send all questions and requests regarding your rights in writing to the address provided in the section Data Controller Information. We will respond to your request immediately, and no later than within one month, unless the exceptional complexity of the individual case requires an extension of this period. To protect you as the data subject, you must properly identify yourself as the applicant, which serves as assurance to the Company that the personal data is being provided to its rightful owner.

Access to Your Personal Data

You have the right to request information about whether we process your personal data, access to that data, as well as information about the processing, in accordance with Article 26 of the Law.

Correction, Supplement, Deletion, and Restriction of Personal Data Use

You have the right to request the correction of inaccurate personal data, as well as the right to supplement, delete, and restrict the use of your personal data.

Data Portability

You have the right to obtain and request the transfer of your personal data.

Right to Withdraw Consent and Right to Be Forgotten

You have the right to withdraw your consent for the processing of personal data, as well as to request the permanent deletion of your personal data processed on the basis of your consent.

Objection to Processing or Handling of Personal Data

You have the right to object to the processing of your personal data, as well as to our handling of your personal data in general. Please send your objection via email to the address provided in the section Data Controller Information, with the subject line Objection to Processing, explaining the reason for your objection and your specific request in the message.

Right to Lodge a Complaint with the Commissioner for Information of Public Importance and Personal Data Protection

At any time, you have the right to file a complaint with the competent authority for personal data protection — the Commissioner for Information of Public Importance and Personal Data Protection (https://www.poverenik.rs/).

Privacy policy changes

The Company reserves the right to amend this Privacy Policy at any time. Any change becomes effective upon its publication on the Company’s website or in another appropriate manner. In this regard, we recommend that you regularly review the section referring to the Privacy Policy to stay informed about the latest updates.
